Nazir - Sotah Connection

Have you ever wondered where the concept of "geder" and "siyug" - fences and protective devices for Biblical Law.

In other words this aspect of Rabbinical Law.

Is there a Biblical precedent or is it just common sense?

[Chazal's authority comes from La Tasur, but how did Chazal know that this method was an appropriate use of their energies?]

The Rambam in his introduction establishes five separate categories of Rabbinic law.

נמצא לפי הכללים שהקדמנו שכל הדינים הקבועים בתורה נחלקים לחמשה חלקים.
והחלק הרביעי הם הדינים שקבעום הנביאים והחכמים שבכל דור ודור על דרך הגדר והסייג לתורה, והם שצוה ה' לעשותם באופן כללי באמרו ושמרתם את שמרתי, ובא בקבלה עשו משמרת למשמרתי. והם שקוראים אותם חז"ל גזרות.


This verse:
ושמרתם את משמרתי - עשו משמרת

This source is the ultimate source for the concept of the Rabbis enacting Takanot.

The Mesilas Yesharim in Chapter 13 asks our initial question in a stronger manner:

CONCERNING THE TRAIT OF SEPARATION
One might ask, "What basis is there for multiplying prohibitions? Have our Sages of blessed memory not said (Yerushalmi Nedarim 9.1), `Are the Torah's prohibitions not enough for you that you come to create new prohibitions for yourself?'

Mesilas Yesahrim, Chapter 11 - Nekeyut


ונדבר עתה מן העריות שגם הם מן החמורים והם שניים במדריגה אל הגזל, כמאמרם זכרונם לברכה (בבא בתרא קס"ה): "רובם בגזל ומעוטם בעריות". והנה מי שירצה להנקות לגמרי מזה החטא גם לו תצטרך מלאכה לא מועטת, כי אין בכלל האסור גופו של מעשה בלבד, אלא כל הקרב אליו, ומקרא מלא הוא (ויקרא י"ח): "לא תקרבו לגלות ערוה" ואמרו זכרונם לברכה (שמות רבה פרק ט"ז): "אמר הקדוש ברוך הוא אל תאמר הואיל ואסור לי להשתמש באשה הריני תופשה ואין לי עון הריני מגפה ואין לי עון או שאני נושקע ואין לי עון, אמר הקדוש ברוך הוא כשם שאם נדר נזיר לשתות יין אסור לאכול ענבים לחים ויבשים ומשרת ענבים וכל היוצא מגפן היין, אף אשה שאינה שלך אסור ליגע בה כל עיקר, וכל מי שנוגע באשה שאינה שלו מביא מיתה לעצמו וכו'". והבט מה נפלאו דברי המאמר הזה, כי המשיל את האסור הזה לנזיר, אשר אף על פי שעיקר האסור אינו אלא שתיית יין, הנה אסרה לו תורה כל מה שישלו שייכות עם היין, והיה זה למוד שלמדה תורה לחכמים, איך יעשו הם הסייג לתורה במשמרת שנמסר בידם לעשות למשמרתה, כי ילמדו מן הנזיר לאסור בעבור העקר גם כל דדמי ליע, ונמצא שעשתה התורה במצוה זאת של נזיר, מה שמסרה לחכמים שיעשו בשאר כל המצות, למען דעת שזה רצונם של מקום, וכשאוסר לנו אחד מן האסורין ילמד סתום מן המפרש לאסר כל הקרוב לו. ועל זה הדרך אסרו בענין זה של העריות כל מה שהוא ממינו של הזנות או הקרוב אליו, יהיה באיזה חוש שיהיה דהיינו, בין במעשה, בין בראיה, בין בדבוש, ואפילו במחשבה

CONCERNING THE PARTICULARS OF THE TRAIT OF CLEANLINESS

We shall now consider the sin of illicit relations, which is also included among the most severe sins, being second only to theft, as revealed in the statement of our Sages of blessed memory (Bava Bathra 165a), "The majority succumb to the sin of theft, a minority to that of illicit relations." One who desires to be completely clean of this sin also requires no little effort, for its prohibition takes in not only the act itself, but anything that approaches it, as Scripture clearly states (Leviticus 18:6), "Do not come near to uncover nakedness." And our Sages of blessed memory have said (Shemoth Rabbah 16:2), "The Holy One Blessed be He said, `Do not say, "Since I may not live with a woman, I will hold her and be free of sin, I will embrace her and be free of sin; or I will kiss her and be free of sin." ' The Holy One Blessed be He said, `Just as when a Nazarite takes a vow not to drink wine, he is forbidden to eat grapes or raisins or drink grape juice, or partake of anything, for that matter, which comes from the grapevine, so is it forbidden to touch any woman but your own wife; and anyone who does touch a woman other than his wife brings death to himself.' " See how wonderful these words are! The prohibition in the case of illicit relations is likened to that in the case of a Nazarite, where, even though the essence of the prohibition involves only the drinking of wine, the Torah forbids to him anything which has some connection with wine. Through what it says concerning a Nazarite, the Torah is teaching the Sages how to make "a fence around the Torah" by way of implementing the authority vested in them to reinforce the Torah's rulings. Using the case of the Nazarite as a prototype, the Torah is instructing the Sages to proscribe, because of a basic prohibition, anything that is similar to it. To reveal God's will in the matter, the Torah did in relation to the mitzvah of the Nazarite what it authorized the Sages to do in relation to all the other mitzvoth, namely, to forbid anything which approaches the nature of what is proscribed, by deducing what is not stated from what is stated. By applying this principle to the area of illicit relations, the Sages prohibited anything partaking of the nature of fornication or approaching it, regardless of the particular avenue of approach, whether that of deed, or sight, or speech, or hearing, or even thought.

Rashi in Beitsa 2b discusses the limitations of Chazal:

[והתניא וכו'] - ואם תאמר: הויא לה גזרה לגזרה, דהנך דמתילדין ביומיהם נמי אינן אסורות אלא משום גזרה דיום טוב אחר השבת, תריץ: הא מצי לאוקומי ביום טוב אחר השבת, דהשתא איכא למיגזר אטו דמתילדין ביומיהם, ואשמועינן הך מתניתין דאפילו ביום טוב אחר השבת מותרות, הואיל ואינם נולדות, ומשום הנך דמתילדן ליכא למגזר, דמילתא דלא שכיחא הוא, בשם רבינו, והא דאמרינן בכולי תלמודא שאין גוזרין גזרה לגזרה - מהאי קרא נפקא: ושמרתם את משמרתי - עשו משמרת, כלומר גזרה, למשמרתי - לתורתי, ולא משמרת למשמרת, שלא יעשו גזרה לגזרה.

Perhaps the reasoning is as follows:

When we take a look at some of the history of what ensued
when unnecessary takanot or enactments were made:

Back at the very beginning:

וַיִּיצֶר יְקֹוָק אֱלֹהִים אֶת הָאָדָם עָפָר מִן הָאֲדָמָה וַיִּפַּח בְּאַפָּיו נִשְׁמַת חַיִּים וַיְהִי הָאָדָם לְנֶפֶשׁ חַיָּה:
(ח) וַיִּטַּע יְקֹוָק אֱלֹהִים גַּן בְּעֵדֶן מִקֶּדֶם וַיָּשֶׂם שָׁם אֶת הָאָדָם אֲשֶׁר יָצָר:
(ט) וַיַּצְמַח יְקֹוָק אֱלֹהִים מִן הָאֲדָמָה כָּל עֵץ נֶחְמָד לְמַרְאֶה וְטוֹב לְמַאֲכָל וְעֵץ הַחַיִּים בְּתוֹךְ הַגָּן וְעֵץ הַדַּעַת טוֹב וָרָע:

ג) וּמִפְּרִי הָעֵץ אֲשֶׁר בְּתוֹךְ הַגָּן אָמַר אֱלֹהִים לֹא תֹאכְלוּ מִמֶּנּוּ וְלֹא תִגְּעוּ בּוֹ פֶּן תְּמֻתוּן:
ד) וַיֹּאמֶר הַנָּחָשׁ אֶל הָאִשָּׁה לֹא מוֹת תְּמֻתוּן:
Rashi:
(ג) ולא תגעו בו - הוסיפה על הצווי, לפיכך באה לידי גרעון, הוא שנאמר (משלי ל ו) אל תוסף על דבריו:
A good question might be:
Why is the touching of the tree fall under the category of "kol hamosif gorea." Does it not fit into an appropriate extension of the actual issur, akin to the grape prokducts that are not wine - forbidden to the Nazarite.

Nachlas Yakov, [super commentary on Rashi] brings the Medrash that Rashi is quoting in full:

בראשית רבה (וילנא) פרשת בראשית פרשה יט
תני ר' חייא שלא תעשה את הגדר יותר מן העיקר שלא יפול ויקצץ הנטיעות, כך אמר הקב"ה כי ביום אכלך ממנו וגו', והיא לא אמרה כן, אלא אמר אלהים לא תאכלו ממנו ולא תגעו בו כיון שראה אותה עוברת לפני העץ נטלה ודחפה עליו, אמר לה הא לא מיתת, כמה דלא מיתת במקרביה, כן לא מיתת במיכליה, אלא כי יודע אלהים כי ביום וגו'.

At this point we must ask:

When is a Gizeirah at risk of losing the value of the
ikur halacha?
Alternatively, how did Chazal gauge what is more/less in regards to the fence protecting the ikur mitzvah, halachah?

Rambam holds that the problem is in the presentation.
Chazal need to make it clear what is ikar and what is tafel [geder]. When they present the deRabanan as being min-haTorah its a problem of baal tosif; as well as an incorrect method of presenting the geder. Adam presented not touching as being the mitzvah from Hashem.
This led to the uprooting of the main principle.

שלא להוסיף על מצוות התורה:
שנמנענו שלא נוסיף בתורה שבכתב ולא בתורה שבעל פה, ועל זה נאמר [דברים י"ג, א'], לא תסף עליו. וכיצד יהיה התוספת, כתב הרמב"ם ז"ל [פ"ב מממרים ה"ט] כגון המורה שבשר עוף בחלב אסור מן התורה, וזה מוסיף על דבר הקבלה שכך קבלנו בפירוש לא תבשל גדי וגו' שבשר בהמה וחיה נאסרו לבשל בחלב אבל לא בשר עוף, וכן אם הורה שבשר חיה מותר בחלב עובר משום לא תגרע, לפי שזה גורע הוא שכך קבלנו שבשר בהמה וחיה בכלל האיסור, עד כאן:

How will we resolve the difference between the Mesilas Yesharim's approach to the source and the Rambam's source?

Conceptually, the precedent is learned from Nazir. The Torah was teaching us how to enact fences. The source itself limits the extent of, or the height of the fence.


Another question that is addressed in Gemara is failed gizeoros - It seems that Chazal made a number of gizeiros that were not accepted by the poeple and therofore not binding.
לפי שאין רוב הציבור יכולין לעמוד בה

Finally, at what point can the rabbis no longer make Gizeiros?
The Rambam in the introduction to the Yad haChazakah states:

נמצא רבינא ורב אשי וחבריהם. סוף גדולי חכמי ישראל המעתיקים תורה שבעל פה. ושגזרו גזירות והתקינו התקנות והנהיגו מנהגות ופשטה גזירתם ותקנתם ומנהגותם בכל ישראל בכל מקומות מושבותם. ואחר בית דין של רב אשי שחבר הגמרא וגמרו בימי בנו נתפזרו ישראל בכל הארצות פיזור יתר והגיעו לקצוות ואיים הרחוקים ורבתה קטטה בעולם ונשתבשו הדרכים בגייסות ונתמעט תלמוד תורה ולא נכנסו ישראל ללמוד בישיבותיהם אלפים ורבבות כמו שהיו מקודם אלא מתקבצים יחידים השרידים אשר ה' קורא בכל עיר ועיר ובכל מדינה ומדינה ועוסקין בתורה ומבינים בחיבורי החכמים כולם ויודעים מהם דרך המשפט היאך הוא. וכל בית דין שעמד אחר הגמרא בכל מדינה ומדינה וגזר או התקין או הנהיג לבני מדינתו או לבני מדינות רבות לא פשטו מעשיו בכל ישראל מפני רחוק מושבותיהם ושבוש הדרכים. והיות בית דין של אותה המדינה יחידים ובית דין הגדול של שבעים ואחד בטל מכמה שנים קודם חיבור הגמרא. לפיכך אין כופין אנשי מדינה זו לנהוג כמנהג מדינה האחרת. ואין אומרים לבית דין זה לגזור גזירה שגזרה בית דין אחר במדינתו. וכן אם למד אחד מהגאונים שדרך המשפט כך הוא ונתבאר לבית דין אחר שעמד אחריו שאין זה דרך המשפט הכתוב בגמרא, אין שומעין לראשון אלא למי שהדעת נוטה לדבריו בין ראשון בין אחרון:

ודברים הללו בדינים גזירות ותקנות ומנהגות שנתחדשו אחר חיבור הגמרא. אבל כל הדברים שבגמרא הבבלי חייבין כל ישראל ללכת בהם וכופין כל עיר ועיר וכל מדינה ומדינה לנהוג בכל המנהגות שנהגו חכמי הגמרא ולגזור גזירותם וללכת בתקנותם. הואיל וכל אותם הדברים שבגמרא הסכימו עליהם כל ישראל. ואותם החכמים שהתקינו או שגזרו או שהנהיגו או שדנו דין ולמדו שהמשפט כך הוא, הם כל חכמי ישראל או רובם והם ששמעו הקבלה בעקרי התורה כולה דור אחר דור עד משה רבינו עליו השלום

Individulaity - the Sinaiatic Experience

אָנֹכִי יְקֹוָק אֱ-הֶיךָ אֲשֶׁר הוֹצֵאתִיךָ מֵאֶרֶץ מִצְרַיִם מִבֵּית עֲבָדִים

Chizkuni:
אמר רבי לוי נראה להם הקב"ה לישראל כמו איקונין שיש לה פנים לכל צד ואלף בני אדם מביטים בה והיא מבטת בכולם, כך הקב"ה כשהיה מדבר כל אחד ואחד מישראל אומר עמי הוא מדבר. אנכי ה' אלהיכם אין כתיב, אלא אלהיך, למה לפי שהיה מדבר עם כל אחד ואחד כסדר שהם עומדים סביב ההר כדכתיב והגבלת את העם סביב לאמר. ואל תתמה שהרי המן כל אחד היה טועמו לפי כחו, ומה המן כך, הדבור על אחת כמה וכמה.

In Sefer Taamei haMinhagim uMikorei Dinim, Rav Dovid Deutsch is quoted:

The reason why the Ten Utterances were said to each individual is to drive home a message: Do not think that "What does G-d care if I do not do my service. After all, aren't there many angels, tzadikim who serve G-d. Their service is much better tahn mine. What does he need mine for? To this Hashem responded, Anochi Hashem Elokeicha...I am Hashem your [the individual, you the lone person] G-d. Imagine in your mind that only you exist. I have no other servants except for you. It all depends on you. [Beshivilacha Nivra haOlam]. [See below how the individual's portion of Torah is unique and necessary as part of the greater whole [Vilna Gaon].


Let's take a deeper look at the Chizkuni. His proof suggests that he holds that people at Sinai had different experiences, dependent on their ability:

Ibn EZra:
אבן עזרא שמות (הפירוש הארוך) פרק יט
ב) ויסעו וכבר נסעו מרפידים כאשר הראיתיך רבים כאלה. ויחנו במדבר הוא מדבר סיני הנזכר, וטעם ויחן שם ישראל אחר שאמר ויחנו במדבר, כי ראשי המטות והזקנים חנו נגד ההר בעבור כבודם, על כן הזכיר ויחן, כי מועטים היו, כי כפי מעלתם עמדו ביום מתן תורה סביב הר סיני כאשר אפרש. ורבינו שלמה אמר, כי כנגד ההר מזרח, והנה כתוב מנגד סביב לאהל מועד יחנו (במד' ב, ב), שהוא מארבע הפאות, כי כאשר יסעו הדגלים כן יחנו:

Ibn Ezra elaborates in Verse 17:
ויתיצבו בתחתית ההר מחוץ לגבול שהגבילם משה. והנה היו במעמד הר סיני כדרך שהציב משה בניהם בשנת הארבעים בכרתו ברית עמהם (דבר' כט, ט), כי בתחלה היו הבכורים הנגשים אל ה', ואחריהם ראשי שבטים הם הנשיאים, ואחריהם הזקנים, ואחריהם השוטרים, ואחריהם כל איש ישראל ואחריהם הטף, ואחריהם הנשים, ואחריהם הגרים, ומשה ואהרן עברו הגבול והיו בהר קרובים אל הכהנים, אעפ"י שלא דבר הכתוב זה מפורש, כי הכתוב אחז דרך קצרה, כי ידענו כי הם לא מרו פי השם, כי הנה כתוב לך רד ועלית אתה ואהרן עמך (שמות יט כד). ואמר משה אנכי עומד בין ה' וביניכם (דבר' ה, ה):

Rashi [Tehilim 29]:
קול ה' בכח - בשעת מתן תורה צמצם את קולו לפי כחן של ישראל שנאמר והאלהים יעננו בקול (שמות י"ט) בקולו של משה

It seems that according to all that we have mentioned, Hashem gave each person what they were capable of hearing at Matan Torah.

R' Avraham Kramer, (brother of the GRA) [sefer maalos haTorah] quotes the Vilna Gaon:

ואמר אחי הגאון זלה"ה, שהוא על פי מה דאיתא במסכת נדה (ל ב), כשהתנוק במעי אמו, מלמדים אותו כל התורה כלה, ומיד כשיצא לאויר העולם, בא מלאך וסטרו על פיו, ולכאורה צריך עיון מה תועלת יש במה שמלמדים אותו, ואחר כך משכחים אותו, והוה כלא למד כלל. ונראה על פי מה שכתב האלשיך, על מה שאנו אומרים ותן חלקינו בתורתיך, לפי שכל הנשמות עמדו על הר סיני וקבלו כל אחד חלקו בתורה, וזה שכתוב בגמרא (מגילה ו ב) יגעתי ומצאתי תאמין, מצאתי דייקא, כאדם המוצא אבדתו, לפי שהוא חלקו, ולפי זה אלו לא היו מלמדים אותו, כשהיה במעי אמו, איך היה יכול להגיע על ידי יגיעתו, ואם לא היה שוכח לא היה צריך ליגע, ואם כן בטל שכר ועונש, ולכך מלמדים אותו חלק תורתו במעי אמו, וזה נקרא כל התורה, רצה לומר מה שנוגע לחלק נשמתו, ובצאתו לאויר העולם, הוא נשכח ממנו, ואחר כך על ידי יגיעתו יכול למצוא אבדתו, ואם כן כל הלומד ואינו מקים, אם כן מוטב לו שלא יצא לאויר העולם, כי בשביל הלמוד לבד, לא היה צריך לצאת לאויר העולם, שגם במעי אמו למד כל חלקו, אבל המקים, משלים כונת הבריאה, שלא היה יכול לקים התורה בעודו במעי אמו הגם שלמדה

In the Otser Taamei haMinhagim, I saw a quote from Sefer Daas Moshe....

Why is that we say "Zeman Matan Toraseinu" on Shavuous. Grammatically we should say zman matan Torah!
He suggests that everyone has their own Torah. We are all mikabel our own Torah. Proportionate to the level of our ability and our purity of our actions, is the level of Kabbalas haTorah that we attain.

So Shavuous is our Matan Torah, and it is specific to each and every individual.

Shabbat - The Ultimate Day of Shevisa [REST]


ב) דַּבֵּר אֶל בְּנֵי יִשְׂרָאֵל וְאָמַרְתָּ אֲלֵהֶם מוֹעֲדֵי יְקֹוָק אֲשֶׁר תִּקְרְאוּ אֹתָם מִקְרָאֵי קֹדֶשׁ אֵלֶּה הֵם מוֹעֲדָי

Speak to the children of Israel and say to them: The Lord's appointed [holy days] that you shall designate as holy occasions. These are My appointed [holy days]:


ג) שֵׁשֶׁת יָמִים תֵּעָשֶׂה מְלָאכָה וּבַיּוֹם הַשְּׁבִיעִי שַׁבַּת שַׁבָּתוֹן מִקְרָא קֹדֶשׁ כָּל מְלָאכָה לֹא תַעֲשׂוּ שַׁבָּת הִוא לַיקֹוָק בְּכֹל מוֹשְׁבֹתֵיכֶם

[For] six days, work may be performed, but on the seventh day, it is a complete rest day, a holy occasion; you shall not perform any work. It is a Sabbath to the Lord in all your dwelling places.


.ד) אֵלֶּה מוֹעֲדֵי יְקֹוָק מִקְרָאֵי קֹדֶשׁ אֲשֶׁר תִּקְרְאוּ אֹתָם בְּמוֹעֲדָם

These are the Lord's appointed [holy days], holy occasions, which you shall designate in their appointed time:



Rashi wonders about the juxtaposition of shabbat next to the holidays.

ששת ימים - מה ענין שבת אצל מועדות ללמדך שכל המחלל את המועדות מעלין עליו כאלו חלל את השבתות וכל המקיים את המועדות מעלין עליו כאלו קיים את השבתות

Why does the Sabbath [designated by God,] appear here amidst the festivals [designated by the Sanhedrin]? To teach you that whoever desecrates the festivals is considered [to have transgressed as severely] as if he had desecrated the Sabbath, and that whoever who fulfills the festivals is considered as if he has fulfilled the Sabbath, [and his reward is as great]. — [Be’er Basadeh ; Torath Kohanim 23:144]

Gur Aryeh explains-

ב] שכל המחלל את המועדים כו'. שגם הם נקראים 'שבת', והם ז' ימים; שני ימים של פסח, יום אחד של עצרת, יום אחד ראש השנה, יום אחד צום העשור, שני ימים של סוכות. והם ז' נגד יום השבת שהוא יום שביעי. והמחלל את המועדות שהם נכללים תחת השבת, כאילו חלל השבת, שהוא יום השביעי. והבן דבר זה היטב, ותמצא איך המחלל את המועדים כאילו חלל את השבת, שהמועדים הם חלקי השביתה, והשבת הוא כולל כל השביתה:







Contrasting Shabbat and the Holidays

א) וַיְדַבֵּר יְקֹוָק אֶל מֹשֶׁה לֵּאמֹר

ב) דַּבֵּר אֶל בְּנֵי יִשְׂרָאֵל וְאָמַרְתָּ אֲלֵהֶם מוֹעֲדֵי יְקֹוָק אֲשֶׁר תִּקְרְאוּ אֹתָם מִקְרָאֵי קֹדֶשׁ אֵלֶּה הֵם מוֹעֲדָי
Speak to the children of Israel and say to them: The Lord's appointed [holy days] that you shall designate as holy occasions. These are My appointed [holy days]:

ג) שֵׁשֶׁת יָמִים תֵּעָשֶׂה מְלָאכָה וּבַיּוֹם הַשְּׁבִיעִי שַׁבַּת שַׁבָּתוֹן מִקְרָא קֹדֶשׁ כָּל מְלָאכָה לֹא תַעֲשׂוּ שַׁבָּת הִוא לַיקֹוָק בְּכֹל מוֹשְׁבֹתֵיכֶם
[For] six days, work may be performed, but on the seventh day, it is a complete rest day, a holy occasion; you shall not perform any work. It is a Sabbath to the Lord in all your dwelling places.

The verse make it sound like Shabbat is a moed. However, normally a moed is an event that is reserved for a holiday who's date and time are determined by the Bet Din. Shabbat is a free standing event. Shabbat is every seventh day regardless of whether or not we keep it. The holidays require man's input. Shabbat does not.

The Ramban has 2 approaches wherein he explains why shabbos is a moed.

אבל הימים עצמם נוהגים מיד והזכיר השבת במועדי ה' אשר תקראו אותם מקראי קדש, שגם הוא יום מועד נקרא אותו מקרא קדש ואחר כן הבדיל שאר המועדות ממנו, ואמר אשר תקראו אותם במועדם, כלומר באי זה יום מן השבוע שיגיעו בו, כי השבת קבוע הוא, ביומו יבא לא נצטרך לקרוא אותו במועדו ועל
Italicדעת רבותינו (ת"כ פרשה ט ה), "אשר תקראו אותם במועדם", רמז לעבורים, שתקראו אתם להם מועדים:
He is differentiating between actually needing to call it a moed or it being a freestanding moed. Either way it is a Moed. The difference is in
אשר תקראו אותם במועדם, In the announcement about when the holiday falls out.

In his 2nd approach, Ramban suggests:

אמר מועדי ה' אשר תקראו אותם מקראי קדש אלה הם מועדי במלאכת עבודה, אבל השבת תשמרו לעשות אותה שבת שבתון מכל מלאכה שבעולם, כי יזהיר בשבת פעמים רבות
Shabbos is actually more of a Moed in the sense that all Melacha is forbidden as opposed to the holidays when melachah n the preperation of food is usually permitted.

Let us now add another question.
Shabbat and the holidays share the basic premise of being.
אֲשֶׁר תִּקְרְאוּ אֹתָם מִקְרָאֵי קֹדֶשׁ

Ramban shares a beautiful idea:

וטעם מקראי קדש - שיהיו ביום הזה כולם קרואים ונאספים לקדש אותו, כי מצוה היא על ישראל להקבץ בבית האלהים ביום מועד לקדש היום בפרהסיא בתפלה והלל לאל בכסות נקיה, ולעשות אותו יום משתה כמו שנאמר בקבלה (נחמיה ח י) לכו אכלו משמנים ושתו ממתקים ושלחו מנות לאין נכון לו כי קדוש היום לאדונינו ואל תעצבו כי חדות ה' היא מעוזכם והנה "מקרא קדש", מלשון קרואי העדה (במדבר א טז), אחרי כן יאכלו הקרואים (ש"א ט יג),

Sforno adds [what perhaps can be another parallel between Shabbat and the Holidays]


(ב) מועדי ה' אשר תקראו אותם מקראי קדש. אחר שדבר בענין הקרבנות ומקריביהם שהכונה בהם השרות השכינה בישראל כאמרו עולת תמיד לדורותיכם פתח אהל מועד לפני ה' אשר אועד לכם שמה דבר במועדים אשר בשביתתם יכוין לשבות ממעשה הדיוט בקצתם לגמרי כענין בשבת ויום הכפורים ולעסוק בכולם בתורה ועסקי קדש, כאמרו ששת ימים תעבוד וכו': ויום השביעי שבת לה' אלהיך שתשבות ממלאכתך ויהיה עסקך כולו לה' אלהיך ובקצתם תהיה השביתה ממלאכת עבודה בלבד כמו שהוא הענין בשאר המועדים והכונה בהם שעם שמחת היום שישמח ישראל בעושיו יהיה העסק בקצתו בעסקי קדש כאמרם ז"ל יום טוב חציו לה' וחציו לכם ובזה תשרה שכינה על ישראל בלי ספק כאמרו אלהים נצב בעדת אל אמר אותם
מועדים שתקראו אותם מקראי קדש פירוש אסיפות עם לעסקי קדש כי אסיפת העם תקרא מקרא כמו חדש ושבת קרוא מקרא וכן על מכון הר ציון ועל מקראיה:

So the Sforno is comparing Shabbat to the Holidays. He says that they are both holy. Shabbat is holier in the sense that it is a day dedicated to learning Torah and matters of holiness. Holidays have a lower level of holiness. There is less prohibited on the holidays than on Shabbat. And part of the day of the holiday is meant to be focused on holy matters.
Why are they both called
מועדים שתקראו אותם מקראי קדש?

Because the people are meant to gather together. The Community based activity is one that is the most holy.

As the Ramban stated:
שיהיו ביום הזה כולם קרואים ונאספים לקדש אותו, כי מצוה היא על ישראל להקבץ בבית האלהים ביום מועד לקדש היום בפרהסיא בתפלה והלל לאל בכסות נקיה, ולעשות אותו יום משתה


Sforno contiues:
אלה הם מועדי. הם אותם המועדים שארצה בם אמנם כשלא תקראו אותם מקראי קדש אבל יהיו מקראי חול ועסק בחיי שעה ותענוגות בני האדם בלבד לא יהיו מועדי אבל יהיו מועדיכם שנאה נפשי


It is up to us to see to it that we we make the holidays holy.

Learning in order to do

Leviticus 22:31

לא) וּשְׁמַרְתֶּם מִצְוֹתַי וַעֲשִׂיתֶם אֹתָם אֲנִי יְקֹוָק:
And you shall guard my commandments and do them! [For] I am Hashem.

Rashi explains:

לא) ושמרתם - זו המשנה ועשיתם - זה המעשה

Shmira is learning and Assia is action, doing the mitzvos.

I have always associated shmor with avoiding sins [Lavvin]. And Asei as command to fulfill mitzvos asei, positive mitzvot.

The super-commentaries discuss Rashi.

Sefer haZikaron suggests that Chazal quoted by Rashi are darshening the verse, because they thought the words in the verse redundant. If you are going to "do the mitzvot" than why do you also have to "watch them?" Therefore ushmartemm is giving you a different message.

Namely Ushmartem - zu haMishnah
Maskil LiDovid suggests that the main purpose of mishnah or learning is in order to guard and do.

This brings to mind the Mishnah in the 4th chapter of Avos:

רבי ישמעאל בנו אומר הלומד על מנת ללמד מספיקין בידו ללמוד וללמד
והלומד על מנת לעשות מספיקין בידו ללמוד וללמד לשמור ולעשות.

You'll notice that there is no option for learning as an intellectual exercise.
Truth demands action.
Action demands truth.

There must be balance of learning and action. One without the other is half a story.

Shavuos - The Holidays - A Framework of Thanksgiving and Prayer

Sforno Leviticus 23:10

אבל בשאר המועדות ייחד לכל מועד דבור לעצמו והתחיל דבור חג השבועות מן העומר כי מאז מתחיל קציר בעומר וספירת השבועות שהם מענין החג הנקרא חג קציר וחג השבועות שבו נתן הודאה לאל יתברך כי אמנם מכוונות הרגלים הם התפלה וההודאה כמו במועד חדש האביב התפלה לאל על האביב וההודאה על החירות. ובהיות כי הצלחת הקציר תהיה כפי מזג הזמן מתחלת האביב עד הקציר כאמרו שבועות חקות קציר ששמר לנו היה העומר הודאה על האביב כמקריב ביכורי השדה לבעלים והיה הקרבן עמו לתפלה על העתיד והיתה הספירה זכרון לתפלת יום יום והיה חג הקציר הודאה על טוב הקציר וחג האסיף על טוב האסיף

The Holidays are about thanking Hashem for the past successes and praying for future achievement.

Shavuos celebrates the splendor of the spring harvest. The Sacrifice that comes with it is a prayer, a plea, for future successes.

The Omer - the counting of the Omer - is a process which reminds us to pray each day for success.

Preperation for Shavuos: True Love - Viahahvta Lireacha Kamocha

Hillel, when approached by the person who wished to convert, on condition that Hillel teach him Torah on 1 foot - responded that the Torah can be summarized by learning from the mitzvah of Vihavta Lireacha Kamocha, Love your fellow person as you love yourself.

Let's take a look at the nature of the Mitzvah, and hopefully, we'll come up with a notion as to where Hillel was directing the convert.

E. Dessler [Volume III, page 89] quotes 2 sources that aid us in understanding how one is supposed to love other people as much as we love ourselves.

Ramban:
אלא מצות התורה שיאהב חבירו בכל ענין כאשר יאהב את נפשו בכל הטוב. ויתכן בעבור שלא אמר "ואהבת את רעך כמוך", והשוה אותם במלת "לרעך", וכן ואהבת לו כמוך (פסוק לד) דגר, שיהיה פירושו להשוות אהבת שניהם בדעתו, כי פעמים שיאהב אדם את רעהו בדברים ידועים להטיבו בעושר ולא בחכמה וכיוצא בזה, ואם יהיה אוהבו בכל יחפוץ שיזכה רעהו האהוב לו בעושר ובנכסים וכבוד ובדעת ובחכמה, ולא שישוה אליו אבל יהיה חפץ בלבו לעולם שיהיה הוא יותר ממנו בכל טובה, ויצוה הכתוב שלא תהיה פחיתות הקנאה הזאת בלבו, אבל יאהב ברבות הטובה לחבירו כאשר אדם עושה לנפשו ולא יתן שיעורין באהבה. ועל כן אמר ביהונתן (ש"א כ יז) כי אהבת נפשו אהבו, בעבור שהסיר מדת הקנאה מלבו ואמר (שם כג יז) ואתה תמלוך על ישראל וגו':

People tend to attempt to express their individuality. Often, we like to think of the positive aspects of ourselves that make us unique. If this uniqueness were truly manifested by myself, and if this is some expression of a positive trait, it would be incorrect of me to want this to be unique. I wish that all my friends and acquaintances, that all people, merited this positive trait. What do I lack if my friends share my good fortune with me? It is only our imagination that is truly satisfied when we 1-Up other people. Loving others as we love ourselves requires us to wish our good fortune, in all areas, on our friends as well.

There is another source though that expresses the positive way of looking at this Mitzvah:

תלמוד ירושלמי מסכת נדרים פרק ט דף מא טור ג /ה"א
כתיב לא תקום ולא תטור את בני עמך היך עביד' הוה מקטע קופד ומחת סכינא לידוי תחזור ותמחי לידיה ואהבת לרעך כמוך ר' עקיבה או' זהו כלל גדול בתורה

If I were cutting some vegatables in the kitchen and my right hand accidentally cut my left hand. It would be ludicrous to suggest that my left hand take revenge upon my right. Similarly, when we view Kllal Yisroel as one organism. One entity. One unity.

It would be inappropriate to ever wish my left hand misfortune, or better stated, I wish that the other parts of my body be as successful, happy and complete as the rest of me.

In light of the upcoming holiday of Shavuot....

R' Chaim Shmueleveitz [based on Sforno] points out that Vayichan sham Yisroel, Ki'ish Echad biLev Echad [And the people camped there - as 1 person with 1 heart:

They helped each other set up camp. This was how their unity manifested itself. People were concerned about others as much as they were concerned about themselves.

This is a prerequisite for receiving the Torah. Seeing the Jewish people as 1 organism. Being concerned for others as we are concerned with ourselves.
